Limitation


1. Rule: six years from the accrual of the action, that is, the commission of the tort (LA 1980).

2. Personal injury, death: three years from knowledge (or 'constructive knowledge').

3. Diseases: if more comes up, it starts afresh (three years).

4. Latent damage to property (Latent Damage Act): in the case of negligence three years upon knowledge, or six years upon accrual (whichever is later). What is accrual depends, but it's not the act of the defendant. Absolute time bar: 15 years.

5. Continuing wrong: six years; so in respect of the time more than six years before there is no claim (=recover for the last six years).

6. Disabilities, fraud: same as in contract (end of disability, knowledge).
