Breaches of E.C. law give rise to torts:

Garden Cottage Foods v. Milk Marketing Board 1984- breaches of Arts. 85 and 86 of the Treaty of Rome gave rise to an action in tort.

Bourgoin S.A. v. Ministry of Agriculture, Fisheries and Food 1986 - judicial review of an 'ultra-vires' decision of Ministry in contravention of Article 30, though the remedy of damages in tort was held to be inappropriate. This was a case of misfeasance in public office.
