Restrictions on and protection of ownership


1. Compulsory Acquisition
a) It is possible by statutes that a public authority acquire private land compulsorily.
b) There are special procedure and special courts for remedies: Land Tribunals.
c) There is a right to compensation where the value of the interest is depreciated by public works.
d) Persons displaced from land receive extra compensation.

2. Town and Country planning
a) Rules are laid down in the Town and Country Planning Acts 1909 and 1990.
b) County and district authorities do the 'planning'.
c) An owner who wishes to develop his property must seek a 'planning permission'.

3. Protection of the right to land
It is an offence to enter or to threaten to use violence for the purpose entering premises unlawfully. Likewise, it is an offence to remain there after having been asked to heave off.
