Aims of the Legal System


General: aim for justice and fairness within the constraints of available resources.

Objectives of the criminal justice system: Primary (punish wrongdoers, protect society, deter people from breaking the law), Secondary (ensure that police, prosecution and members of the judiciary act fairly, guaranty speedy trials, ensure that civil liberties of the accused, of victims and members of society are not interfered with).

Objectives of the civil justice system: Primary (provide a means by which civil disputes can be resolved in accordance with principles of fairness and justice), Secondary (provide an efficient, cost effective, speedy and affordable system by which civil cases can be disposed of).
